The Ministry of Defence approved criteria for determining defense industry enterprises as critically important

The Ministry of Defence has approved the criteria for determining enterprises, institutions, and organizations in the defense industry, aircraft manufacturing, and space activities as being of importance to the national economy. The Ministry of Defence reported this.

These criteria maintain the current approach to identifying important enterprises. For business entities that have already received the status of an enterprise of importance to the national economy and the validity period of this status has not expired, no additional actions or changes to the documents are required.

According to the department, enterprises that meet the requirements and claim the status of important for the national economy in the defense industry may be entitled to reserve up to 100% of military-duty employees. The criteria themselves are as follows:

  1. Execution of a state contract (agreement) in the field of defense or participation in its execution on the basis of agreements, in particular foreign economic ones. The volume of production of defense products must be more than 50% of the total volume of the enterprise for the last reporting period.
  2. Obtaining state financial support in the form of grants in accordance with Government Resolution No. 262 "Some Issues of Ensuring the Development of Innovations and Technologies for Defense Needs."
  3. Performing the functions of an authorized entity for the management of state-owned objects, which regulates, controls and coordinates the activities of defense industry enterprises.

Enterprises, institutions and organizations in the defense industry that do not meet the above criteria may receive the status of important for the national economy . However, they must meet at least three of the requirements listed below:

  1. Execution of government contracts in the defense sector.
  2. Involvement in the implementation of defense orders under contracts, including foreign economic contracts.
  3. Inclusion in the electronic register of selection participants and executors of public contracts.
  4. Participation in the implementation of state target programs in the fields of aircraft construction or space activities.
  5. Participation in the implementation of defense industry development programs, the introduction of new technologies, and the expansion of production capacities.
  6. The production of goods, performance of work or provision of services used by defense industry enterprises for the manufacture of defense products.

If enterprises meet at least two mandatory criteria of Government Resolution No. 76 "Some Issues of Implementing the Provisions of the Law of Ukraine "On Mobilization Training and Mobilization" Regarding the Reservation of Conscripts for the Period of Mobilization and Wartime", they may be recognized as critically important for the functioning of the economy and ensuring the livelihoods of the population during a special period. This will allow them to reserve up to 50% of conscripts.

Recall that a law was previously signed on the temporary reservation of defense industry workers without registration documents. This innovation gives critical enterprises the right to reserve people for 45 days if their registration documents are not properly executed.
